Situation
Active Environmental Services, Inc. was contracted to complete the closure of a Resource Conservation and Recovery Act (RCRA) facility in Columbus, Indiana. In 1998 a fire and associated contamination from the facilities stored materials caused the IDEM Office of Land Quality, Permits Branch to require the remediation of the facility. The site was a Small Quantity Generator and was required by IDEM to complete a RCRA Closure as required by 40 CFR 264 Subpart G. The contaminated soil was removed after completing the IDEM required Closure Plan that included a Sampling and Analysis Plan for the site. The over excavation of the soils and the laboratory results non-detect results for the soils. The area was backfilled and compacted by the client. The site received a Closure Letter from Idem on December 11, 2003. In addition to the closure letter the site was reclassified as a non-handler and is no longer subject to the financial assurance and liability coverage for a Hazardous Waste Management Unit. This resulted in the client receiving a reduced insurance rate for the property from the carrier and the ability to use the area that IDEM considered as a Hazardous Waste Management Unit.
Corrective Action
Monitored Natural Attenuation was the remediation method used and approved by IDEM for the site. The "Covenant Not To Sue" was issued in 2003.
